It is time to update the New Mexico Local Bankruptcy Rules (“NM LBRs”), adopted on November 15, 2014, with amendments on December 1, 2017 and April 1, 2019. The NM LBRs are posted to the Court’s website:www.nmb.uscourts.gov under the tab “Forms and Local Rules.”
Clerk’s office staff have been working on the new version for many months – hoping to make it easier for information to be updated and for the search function to be more intuitive.
Attorney ECF Users can refer to the manual for information about case opening, filing documents, submitting orders, etc. Information in the manual can also be found by performing a search using the Search this site field located in the top right-hand corner on our website.
At its March 2023 and September 2023 sessions, on the recommendation of the Committee on Court Administration and Case Management, the Judicial Conference approved inflationary adjustments to fees on the appellate, district, and bankruptcy court miscellaneous fee schedules, as well as on the Court of Federal Claims and the Judicial Panel on Multidistrict Litigation miscellaneous fee schedules pursuant to 28 U.S.C. §§ 1913, 1914, 1930, 1926, and 1932. These changes are scheduled to become effective December 1, 2023.
The United States Bankruptcy Court for the District of New Mexico has created a new recommended Form NM LF B2030, Disclosure of Compensation of Attorney for Debtor(s) for use in chapter 7 and chapter 13 cases. Form NM LF B2030 is recommended for use instead of Director’s Recommended Form B2030 (Form 2030) in chapter 7 and chapter 13 cases. The Court has found that use of Director’s Recommended Form B2030 often results in disclosures that do not comply with the requirements of 11 U.S.C. § 329(b) and Fed.R.Bankr.P. 2016(b).
On June 6, 2023, the Judicial Conference Committee on Rules of Practice and Procedure (Standing Committee) approved publication of proposed amendments to the following:
Appellate Rules 6 and 39;
Bankruptcy Rules 3002.1 and 8006;
Official Bankruptcy Forms 410, 410C13-M1, 410C13-M1R, 410C13-N, 410C13-NR, 410C13-M2, and 410C13-M2R; and
Civil Rules 16, 26, and new Rule 16.1.
The comment period is open from August 15, 2023 to February 16, 2024.
On June 7, 2022, the Judicial Conference Committee on Rules of Practice and Procedure (Standing Committee) approved publication of proposed rule amendments. Contents of the proposed amendments can be viewed on the US Courts national web site.
